Round Table Files BIA Amicus Brief: Pro Se Respondent

On June 28, 2024 the BIA invited amici to brief the following question: “What’s the scope of the Immigration Choose’s responsibility to develop the file for a professional se respondent? See, e.g., Arteaga-Ramirez v. Barr, 954 F.3d 812 (fifth Cir. 2020); Matter of J-F-F-, 23 I&N Dec. 912, 922 (A.G. 2006); Matter of S-M-J-, 21 I&N Dec. 722, 723-24, 28-29 (BIA 1997); see additionally Quintero v. Garland, 998 F.3d 612, 623-26 (4th Cir. 2021) (discussing attainable sources of authority for such an obligation). Is that this responsibility affected by particular person traits of the respondent, similar to training degree or language potential?”
