The BIA’s willpower have to be vacated as a result of it fails to account for the credible dying threats that Aben acquired. … “[W]e can not affirm a call that fails to deal with key proof.” It’s true that dying threats alone will not be essentially persecution. However when accompanied by beatings, these threats can’t be stated to be inconsequential. On the very least, the BIA should deal with this proof.
